During the 2009 legislative session, former state senator Margaret Carter served as co-chair on the Joint Ways and Means committee which approved a bill that appropriated funds through new legislation to the Dept. of Human Services in the 2009 Legislative Session. The measure””HB 2009″”authorized the creation of addition deputy director positions. Margaret Carter was hired as the Deputy Director for Human Services Programs.

As a state senator, Carter earned $21,612 per year. In her new position, Carter will be making $121,872, fully $100,000 more than she made as a state senator.Carter’s employment in this new, lucrative position was assured. First, Carter lobbied the Director of the Department of Human Services for the position. It is not entirely clear when Carter started lobbying for the position””before or after HB 2009 became law””but it is clear that Carter wanted the $100,000 pay raise. Second, Carter lobbied the Governor’s office for the position.

Finally, unlike most candidate recruitment efforts that interview numerous candidates for an open position (especially a position with the responsibilities as the Deputy Director of Human Services Programs), the Department of Human Services only interviewed Carter for the position, virtually guaranteeing her employment as the new Deputy Director.

Even The Oregonian reported in August that Carter talked with both the Director of the Department of Human Services and the Governor’s office about the position. Carter’s lucrative position was created by the 2009 Legislature by House Bill 2009. Legislative records show that Carter’s committee worked on the measure.

In addition to the ethically questionable circumstances surrounding Carter’s employment, there are likely legal issues as well. Article IV, Section 30 of the Oregon Constitution prohibits legislators from filling “office(s) of profit” that the legislators themselves created during the legislative session. This constitutional provision is intended to avoid the circumstance where a legislator trades her vote in return for a lucrative job in an agency in which the legislator exercises control. In short, this constitutional provision is intended to prohibit exactly the circumstances surrounding Carter’s employment.

Article IV, Section 30 of the Oregon Constitution:
No Senator or Representative shall”¦be appointed to any civil office of profit which shall have been created during such term [i.e. created during the time for which the Legislator was elected].

A civil office of profit is any office that is continuing, prescribed by law, and invested with some powers of sovereignty. Wells v. State of Indiana, ex. rel. Peden, 175 Ind. 380, (1911). Deputy director positions are by definition a “civil office of profit”. Id. at 384-385.

House Bill 2009, passed by the 2009 Legislature, created the position of Deputy Director of Human Services.

    Looking back for the purpose of “gotcha” is not as helpful as looking back for the purpose of analyzing what not to do in the future.

    Ethically questionable circumstances, indeed. This is old news though. I remember reading about this months ago. If she had an ounce of ethical sensibilities she would have resigned already.

    Oh, she’ll resign. In three years. When her PERS pension kicks in, paying 100% of the 3 highest income years that she worked. For the rest of her life. Glad she’s already 73 yrs old (not wishing her a speedy death, just glad taxpayers won’t have to fund her for more than 10+ yrs.)

      This is the entire reason she decided to take this job. After three years, her lifetime pension goes up SIX FOLD. And then she will retire.

    Oregon is getting to be known for this kind of thing. That’s why state government, and state workers in particular have such an image problem. Remember Jane Cease? She’s the boob who screwed up the purchasing of a new DMV computer system so bad it ran millions over budget and as I recall was in question as to whether it would ever work at all. She was rewarded with a lucrative sit back and let the bucks roll in position after that performance.

    Now would be a really good opportunity for all those state workers who want to improve their image to get out in front of the curve and storm the ramparts with a broken bourbon bottle to demand this sort of theft stop.

    State workers get mighty riled when anyone questions their integrity. That’s fine, anyone would when their integrity is challenged. However given the blatancy of this incident of corruption more respect would be given if the honest state workers were at the forefront in speaking out against this sort of thing.

    As usual though, there isn’t a lot to be heard.

    It would be refreshing to see a few union reps for state workers speaking out of this. It would go a long way to improving their image.

    Let’s not forget the incidents at two Portland Safeway stores that Senator Carter, the paragon of integrity and patron saint of the African American community, was involved in.

    Safeway at the Lloyd Center.
    She was waiting to be served while a white clerk was waiting on another customer who is an African American woman. She complains to the store manager and cites racism as the reason for not being waited on in a timely manner. She demands a meeting with top Safeway management from the headquarters in California. The meeting is granted. She “shakes down” Safeway management Jesse Jackson style for her favorite charity. Afterwards, the area in which the incident happened in the store was set up with mirrors and a monitoring camera.

    She and her adult daughter are shopping together. They go through the check stand and on the way out of the store an alarm goes off. She and her daughter are stopped by a security guard who is African American. He asks to check their groceries and finds that a tag on an expensive item was not removed by the checker and the situation is resolved.
    Senator Carter and her daughter sue Safeway, the security company and the alarm tag company for various claims including false imprisonment.

    Look out if you work in a Safeway store and see Margaret Carter coming your way.

      Ok – I’m not disputing that this sort of “racism” shake down is probably the most common form of racism out there. I lived in Albany for a while and the mayor at the time and his family were notable for this sort of nonsense. However do you have any actual news cites for these incidents? Id love to see them.

    The incident at the Safeway at MLK and Ainsworth went to trial. She and her daughter were asking for approximately $1 million in damages. The judge didn’t have the common sense or the intestinal fortitude to dismiss the case. The jury however saw through the folly and rewarded her and her daughter 0. You can find the case in the Multnomah County court records. I’m guessing the news media did not report this story.

    Regarding the incident at the Safeway at Lloyd Center, this was done very quietly and to avoid a probable lawsuit by Carter. No news at 5.

      Ok – Well, I guress what I am asking is you start this with “Lets not forget the incidents at two Portland…” What I am asking is how are we supposed to not forget them if they were never reported, and thus we were nevere aware, in the first place?

      Im other words, how did you become aware of something that at least in the Lloyd center event, seems wholly unverifiable?

      Im not doubting that these events happened, Im just saying I was unaware of them and wanted to read up on them a little.
