HB 3054: Increases rent control

HB 3054 seeks to add more rent price control by limiting rent price and tying rent to CPI (Consumer Price Index)

Oregon House Bill (HB3054) seeks to reduce a landlord’s maximum rent by limiting it to a maximum increase of 10 percent of what the property owner of a dwelling and home in a facility purchased it for or using CPI data to calculate the maximum rent.

Two headlines this week show that rent control is not working  and the whole housing problem is getting worse.

Despite Oregon having one of the nation’s toughest rent control laws, rent is still rising — which is why rent control fails nationwide.

The House Bill (HB3054) summary reads: “Reduces maximum rent increases for rental spaces in a facility to match changes to the consumer price index. Limits to 10 percent the maximum increase in rent paid by the purchaser of a dwelling or home in a facility. Prohibits a landlord from requiring aesthetic improvements or internal inspections as conditions of sale of a dwelling or home in a facility.

The Oregon Department of Administrative Services will use data calculated by the Bureau of Labor Statistics of the United States Department of Labor CPI of a one-year average of all urban consumers of the western region. Once the official numbers have been reported on CPI, the Oregon Department of Administrative Services calculates a base of seven percent plus CPI. The bill (HB3054)  also gives the Oregon Department of Administrative Services the option to choose 10 percent if the CPI calculation is greater than 10 percent. This effectively means that if the bill passes, there will be a maximum annual rent increase percentage of 7-10 percent. 

In addition, the new price percentage range, House Bill (HB3054), also states “ A landlord may not require that a selling tenant, prospective purchaser or purchaser consent to the inspection of the interior of the dwelling or home, including as a condition of:
(a) Acceptance of the notice of sale under subsection (8)(a) of this section;
(b) Approval of a sale under this section; or
(c) Approval of a new tenancy by the purchaser
