Dealing with Abrego Garcia

So Kilmar Abrego Garcia was arrested and deported to El Salvador as part of President Donald Trump’s efforts to rid the United States of illegal aliens who have been convicted of violent crimes and/or are subject to existing orders of deportation. Good on Mr. Trump. The only problem is that Mr. Garcia has not been convicted of a violent crime in the United States and is not the subject of an existing deportation order. Oops.

I’m not saying that Mr. Garcia is not an illegal alien, a gang banger, a member of a now-designated terrorist organization, a violent felon, a wife beater or an all around dirtbag. What I’m saying is that he has not been arrested and/or charged with any of these things.

If this were truly a mistake one wonders why administration officials, after discovering the error, didn’t just simply secure him from escape, put him on a plane and sent him back to someplace in the United States where a court of competent jurisdiction could have arraigned Mr. Garcia on virtually any of those charges – including being an illegal alien – and jailed him and housed him at Guantanamo Bay pending trial. That would have been the common sense thing to do. Get him off the streets, isolated him as a danger, and proceed with whatever due process rights to which he may be entitled. Boom! Problem solved.

Unless, or course there is a whole different set of priorities at play.

Mr. Trump has been critical of whether the United States Constitution extends the same constitutional rights to those here illegally as those who are citizens or are here otherwise legally. That question remains to be answered by the United States Supreme Court. So if you want to test that legal theory who better to serve as a defendant than some dirtbag like Mr. Garcia. The last thing you would want is a defendant whose life and future tug at our heart strings. While I consider myself knowledgeable about the application of our Constitution, I have artfully avoided participating in the nuances of criminal law, including immigration law and, therefore, cannot deliver a good guess as to the outcome other than that Mr. Garcia is the perfect candidate.

And if that is not the intention of Mr. Trump’s administration to test those constitutional guarantees for illegal aliens then all Mr. Trump has accomplished is allowing another group of dirtbags like Sens. Chris Van Hollen (D-MD), Chris Murphy (D-CT), Gov. Gavin Newsom (D-CA), and the Squad, free media time to raise money from the Progressive’s army of wealthy donors while fawning of this miserable excuse for a human being. Most of these morons treat Mr. Garcia as a good husband and father who is a victim of an “unjust” system. This is another instance, like so many others proffered by the Democrats that that the visible reality is quite the opposite of their narrative. In such case, I would add to my recommendation about bringing Mr. Garcia back, charging him, arraigning him but instead of housing him at Gitmo consign him to monitored house arrest at Mr. Van Hollen’s home. That kills two birds with one stone. It secures Mr. Garcia in a most visible way because the media will be all over Mr. Van Hollen and Mr. Van Hollen will get a belly full of dealing with a dirtbag like Mr. Garcia.

Now that’s common sense.
