Bill gives lawmakers power over ballot language

HB 3390-2 gives the Oregon Legislative politicians new power to write all ballot titles and explanatory statements (1) for all initiative referrals to voters from the 2025 Legislative session (including proposed statutes and amendments to the Oregon Constitution) and (2) for all petition referendum on any legislation enacted during the 2025 session placed on the ballot by voter petition process.

It passed the House and is now in the Senate.

#6. Tell them that politicians should not be involved in writing ballot measure language and that politicians should sue the same process that ordinary voters use (which include the Attorney General and several appeal processes).

Below is the official explanation.

HB 3390-2 explanation, “It creates a joint legislative committee to prepare the ballot title and explanatory statement for any amendment to the Oregon Constitution referred to the ballot by the Eighty-third Legislative Assembly during the 2025 regular session, or if all or part of any Act is referred to the ballot by the Eighty-third Legislative Assembly or by a referendum petition. The amendment permits any elector who is unsatisfied with ballot title or explanatory statement to petition the Oregon Supreme Court (Court) seeking a different title or statement. It authorizes the Court to review the ballot title and explanatory statement and allows the Court to modify the title or statement or refer them to the Attorney General. The amendment declares an emergency and makes the measure effective on passage.”
