The Presumption of Innocence: Abandoned by the Left

It’s not enough that the liberal/progressive/socialist elites of the Democrat Party have urged the destruction of the Second Amendment’s Right to Keep and Bear Arms and the Electoral College but the fundamental protection of Presumption of Innocence is now under full attack. Witness the savage attacks on now Supreme Court Justice Brett Kavanaugh.

An unsubstantiated accusation of sexual attack by a woman who could not provide any corroborating evidence – not the time, not the place, not even the year – was deemed sufficient to cause every Democrat member of the Senate Judiciary Committee to pillory Mr. Kavanaugh despite an impeccable record of public service. The facts surrounding the accusations were so vague that not a single witness identified by the accuser would concur in her accusations. For the Democrat members – and I mean each and every Democrat member of the committee – it was more than sufficient for the accusation to be made regardless of its truth so long as the accused was white, male and appointed by President Donald Trump. (Please remember that a similar accusation was made against the sitting lieutenant-governor of Virginia, Justin Fairfax, a Black male Democrat, that has since disappeared into the vacuum specifically reserved by liberals to avoid acknowledging the hypocrisy of their feigned outrage.)

That’s it. An accusation made by a woman who we now know was motivated in part by her views on preservation of the right to a taxpayer funded abortion on demand without any supporting information was sufficient in the minds of Democrat members of the Senate Judiciary committee to convict Mr. Kavanaugh – and most particularly in the minds of those Democrat members who subsequently announced their intention to run for the Democrat nomination for president in 2020. But it didn’t end there.

This past weekend the New York Times published an article claiming sexual predation on another woman by Mr. Kavanaugh. The ink was barely dry before Democrat presidential candidates (Sen. Cory Booker (D-NJ), former mayor Julian Castro (D-San Antonio), Sen. Kamala Harris (D-CA), former congressman Robert O’Rourke (D-TX), Sen. Bernie Sanders (Socialist-VT) and Sen. Elizabeth Warren (D-MA)) raced to demand Mr. Kavanaugh’s impeachment. The trouble with the story is that it was false from beginning to end. The person making the accusation was not the victim but rather a former Clinton defense attorney, Max Stier with whom the New York Times never spoke. More importantly, the alleged victim denies any knowledge of the alleged attack. So blatant were the lies in the story that the New York Times was forced to acknowledge that it never sourced the allegations. (Today there is no difference between the Democrat Party and the mainstream media (New York Times, Washington Post, NBC, MSNBC, CNN, etc.) when it comes to defaming anyone unaligned with the Democrat liberal/progressive/socialist cabal.)

The presumption of innocence was nowhere to be found. That kind of bigotry – bigotry based on someone’s political beliefs, affiliations, race or color – is just as vicious, myopic and corrosive as any other form of bigotry. And the idea that the major candidates for the Democrat nomination all support this rush to judgment should call into question their fitness to serve as President of the United States.

There is a segment in the political class that seeks to excuse this conduct as a means of “astericking” Mr. Kavanaugh should the Supreme Court consider overturning Roe v. Wade and thus suggesting that any deviation from Roe v. Wade is illegitimate – much in the same way that the left sought to de-legitimize the presidencies of George W. Bush and Donald Trump. But that is dangerously naïve.

It is even more disconcerting when we see Democrat officials accept the violence of groups such as Black Lives Matter and Antifa in the name of “social justice.” And these same Democrat presidential candidates so willing to condemn Mr. Kavanaugh without proof were also supportive of the mob demonstrations (supposedly spontaneous but in fact organized in cooperation with the Democrat leadership) during Mr. Kavanaugh’s confirmation hearings.

The suspension of tenants of the Constitution – particularly those relating to individual rights – leads quickly to violence. The further growth of these actions – as promoted by Saul Alinsky – will lead to further violence. When encouraged by a major political party, this intolerance, this violence, this abandonment of the rule of law will inevitably lead to the end of our democracy. It is the historical march of socialism.
