SB369: Governor can’t bypass Legislature


Senate Bill 369 seeks to stop the Governor and State Agency from enacting policies for reducing carbon emissions without Legislation Approval.

Oregon Senate Bill (SB369) aims to return power to the legislators by stopping the governor, state agencies, and state commissions from taking measures to reduce greenhouse gas emissions unless the Legislature has created a law to do so.  When Governor Kate Brown couldn’t pass a massive carbon tax, she simply went around the Legislature to enact many of its provisions and effects with executive orders.  This is not democracy.

The Senate Bill (SB369) summary reads “Prohibits the Governor and specified state agencies from taking measures to reduce greenhouse gas emissions in Oregon unless authorized by the Legislative Assembly by law enacted on or after the effective date of the Act” 

In addition, this bill also undoes Governor Brown’s executive order Executive Order 20-04, as the enactment date of this bill, if passed, “reverse any action, repeal any rule or undo any adopted policy that was undertaken under Executive Order 20-04 because subsection (1) of this section eliminates any legal authority underpinning Executive Order 20-04, rendering Executive Order 20-04 null and void as of the effective date of this 2025 Act.

The bill sponsor is State Senator David Brock Smith (R).
