Gun Measure 114 struck down. Cites “Right to self defense”

Harney County Circuit Court Judge Robert Raschio said the Measure 114 gun law violates the State Constitution.

Judge Robert Raschio said;

•  “Oregon citizens have a right to self defense against an imminent threat of harm, which is unduly burdened by Ballot Measure 114″

• “…citizens cannot rely on law enforcement to respond quickly to their needs if they are subject to a break in or threat of deadly physical harm.Victims can be left without a law enforcement response for hours,” he wrote. “A citizen’s need to protect themselves, their loved ones and their property is immediate as there is no one else (who) will be there to do it for them.”

• “The court finds no proof offered demonstrated Large Capacity Magazine bans would reduce the number of causalities in the future. Any such conclusion would be mere speculation by the court which it will not engage,”

• “mass shooting events are tragic and often involve the most vulnerable sections of the population. However, the court finds that the number of people killed and injured is statically insignificant compared to the number of lawful gun owners.”
